Will of Daniel Cheney

Rock County, Wisconsin

The last will and testament of Daniel CHENEY of the town of Turtle County of Rock and state of
Wisconsin. I Daniel CHENEY considering the uncertainty of this mortal life and being of sound mind and memory do make and publish this my last will and testament in manner and form following (That is to say:) First: I give and bequeath unto my beloved wife Saphrona CHENEY the sole use of all my property real and personal (after paying all my debts expenses of last sickness and funeral charges) during her natural life. Item: I give and bequeath unto my two grandsons George A. CHENEY and Carrol CHENEY the sum of two hundred dollars each to be paid at the decease of my wife Saphrona CHENEY.
Item: I give and bequeath unto my son-in-law Stephen B. ROBINSON one half of forty acres of land
which I own in the town of LaPrairie County of Rock and State of Wisconsin provided this item is upon this express condition that the said Stephen B. ROBINSON shall remain with me and my wife and provide for our wants and maintenance upon such terms as we and he may agree upon from time to time during our (or either of our) natural lives
Item: I give and bequeath unto my Daughter Hannah KELLOGG the sum of fifty dollars
And lastly: I give and bequeath unto my son Alonzo CHENEY all of the remainder and residue of my
property real and personal after paying the foregoing legacies all of which are to be paid at the decease of my Wife. And further it is my wish and hope that if at any time after the execution of this my last will and testament my Daughter Hannah KELLOGG should be reduced to want, that my Son Alonzo CHENEY would from the kindness of a brothers heart grant her such relief as he by the blessing of God may be able to afford. I hereby revoke all former wills by me made In witness where of I have hereunto set my hand and seal the12th day of July in the year of our Lard one thousand eight hundred and sixty

The above instrument consisting of one sheet was now here subscribed by Daniel CHENEY the
testator in the presence of each of us and was at the same time declared to by him to be his last will and testament and we at his request sign our names here unto in his presence as attesting witnesses

The Last Will and Testament of Daniel CHENEY Deceased
& the Certificate of Probate -- Filed June 17, 1861

To the County Court of said county
The petition of Sophronia CHENEY of the Town of Turtle in said County respectfully represents that
Daniel CHENEY late of said Town deceased, on the thirtieth day of May 1861 at said Town died. That he died testate as your petitioner believes. That the instrument in writing herewith presented to this Court is the Last Will and Testament of said Deceased as your petitioner believes that the children and heirs at laws of said Deceased are as follow:
Alonzo H. CHENEY who lives in California his Post Office address being Sacrament.
Hannah, Wife of James S. KELLOGG who resides in the Town of La Prairie.. that the said
Deceased left a Widow your petitioner and two Grandchildren by a Deceased Son Hazen B. CHENEY late of said Town of Turtle Wis. George A. of the age of ten years and Corol H. of the age of eight years.
Your petitioner would further present that the goods, chattels and personal estate of said Deceased as
she is informed and believes amount to about the sum of Six hundred and fifty dollars and that said Deceased left about forty four acres of real estate of the estimated value of two thousand dollars and that he left no debts of any considerable amount
Your petitioner would pray that said Will instrument may be admitted to probate and that on the
probate of the same John H. COOPER of said Town of Turtle may be appointed Administrator of said Estate with said Will and that Appraisers may be appointed foreseen to the Statute in such case made and provided
